Dying Intestate, If someone dies without a will they are said to die intestate. The surviving spouse and people married with children are all covered by the laws of intestacy and intestacy rules.


If a person dies without leaving a will or a valid Will this is known as dying intestate. The laws of intestacy apply.  These laws are set out to try an apportion the deceased estate in a way that is fair to surviving spouses, children and other direct next of kin.
